hereinafter the same)and engages in a flight within a radius of 9 kilometres from the aerodrome or said place for take-off and landing other than an aerodrome, and lands at an aerodrome or a place for take-off and landing other than an aerodrome within said defined area.

 

(Navigation in case of Radio Equipment Failure)
Article 206. Any aircraft flying under instrument flight rules in a control area or a control wne shall, in the case of radio failure, observe the procedures described below;
(1)Under visual contact with meteorological conditions, to continue flight maintaining visual contact with meteorological conditions and to land at the nearsst aerodrome where a safe landing is considered possible, and immediately report that effect to a unit conducting air traffic control service;
(2)Under instrument-monitored meteorological conditions, to continue to navigate according to the flight plan for which approval "'as obtained under Article 97 paragraph 1 of the law, in addition to complying with the procedures described below, until the airspace over the site (in case there is a specific radio navigational facility specified as a point from which to proceed to the destination, the airspace over the point; hereinafter the same)of first intended landing (hereinafter in this Article referred to as "destination")specified in the flight plan;
a)In case the permission for approach for landing (hereinafter referred to as "permission for approach")has been issued in the instructions received from the unit conducting air traffic control service before the occurrence of the radio failure (hereinafter referred to as "instructions prior to failure"), or an estimated time for the issuance of instructions for the permission for approach (hereinafter referred to as "estimated time of approach")has been given, to conduct the flight so as to arrive by the approach time for which said permission has been received or by said estimated time of approach;
b)In case a holding pattern at a specific point has been instructed and the estimated time of approach has been given in the instructions prior to failure, to conduct the flight so as to arrive by the estimated time of approach after holding at said point;
c)In case, in the instructions prior to failure, a holding at a specific point has been instructed, the estimated time of approach has not been given, and the time at which the next instructions will be issued has been given, to fly toward the airspace over the destination after holding at said point until said time;
(3)Upon arrival at the airspace over the destination in accordance with the provisions of the preceding subparagraph, to commence descent immediately in a case where permission for approach has been issued in the instructions prior to failure, or to commence descent in other cases after holding over said site until the time specified below (or to commence descent as soon as possible, when descent was impossible at said time);
a)Said estimated time of approach, in a case where the estimated time of approach has been given in the instructions prior to failure;
